hello my name is albert silva and i dont know if iam asking the right person but i will be a father this coming december and i would like to see how i could get more information on child support.well my question is iam not currently with the babies mother but i feel i have the right to see my baby when he is born,..the mother of baby tells me she will not let me see him when he is born i just feel disapointed that she is taking things this way and being that iam new to this i dont know what to do another thing people have advised me to get lawyer dut at the moment i dont have money to hire one lawyers are very expensive so what could i do 'my baby is not born yet and i feel i love hime so much how can i get some help on this issue  betoas2007@hotmail.com

Since you have never been married you will need to establish paternity.  That is usually done with a blood test unless both parties admit paternity.   This is done for child support and visitation rights.   You will not be able to establish paternity until the child is born.

I would try to contact the legal aid society to help you with this. Legal aid a groups of third year law students that assist (for free) persons who truly cannot afford a lawyer.

This is a good time to start, have your ducks ready before the baby is born so on his/her birth date you can file.

You will have to petition the district court in your county to establish paternity and custody.  This site strongly encourages joint custody, and even more so joint physical care.  Joint physical care is true 50/50 custody, where joint custody one parent has primary possession, but is supposed to include the other parent in decision making.

Do you and the mother both live in Iowa, and if so what county(s)?

Is the child going to be born in Iowa?

I made an error you can request that the courts begin the process while the mother is still pregnant.  I noticed one thing in the wording of 600B, they sure intended that law to come after good ole dad didnt they?!  Doesnt say much about dad wanting to do the right thing.

Anyways heres the law allowing it.

600B.9 Time of instituting proceedings.
The proceedings may be instituted during the pregnancy of the mother or after the birth of the child, but, except with the consent of all parties, the trial shall not be held until after the birth of the child and shall be held no earlier than twenty days from the date the alleged father is served with notice of the action or, if blood or genetic tests are conducted, no earlier than thirty days from the date the test results are filed with the clerk of the district court as provided under section 600B.41 .

Legal Aid may be different in different parts of the state. Here in Northeast Iowa, they do not deal at all with custody/child support issues, unless there has been a charge of some sort of abuse. They deal primarily with domestic abuse and some elderly issues. Good luck if Legal Aid in your area covers any more than that.

I was thinking that they may assist him with establishing paternity.

It doesn't hurt to check, but I wouldn't count on it. Establishing paternity is easy. Getting visitaiton is hard.

I agree the paternity part is not difficult, but once thats established 598.41 allows for visitation, joint custody, and/or joint physical care.  I think the guy would at least come out of it with visitation, although it will mean child support as well.

I know Legal Aid in Des Moines handles child custody cases because they did when my oldest daughters mom and I were going through custody because that's who she went through and there was never any domestic abuse.

Save some money to buy pampaers and stuff. Don't get to caught up in the court. The time they will take will defeat the purpose. Try to talk to your girl's family. Let them know how you feel and stay cool.
