My boyfriend went in front of a judge and got an order for satisfaction of child support in the amount of $2500. It has been turned into csru. They have now sent us a motion for an amendment. The original order states he owes $2293 to the state for support paid to ex from the state, and $1735 to the ex for back child support. The state kept $1698 from his income tax, and was told it was applied to the balance to the state, leaving $595 owed to state and $1735 owed to ex, total then is$2230. Now that he got an order of satisfaction from a judge for $2500, the csru sent us a copy of a motion they are putting in front of a judge on 5/1, which states that he only owes his ex $278 and he still owes the csru $2293. If that is the case then the $1698 should have been sent to ex, which it has not. So they now want to keep the $1698 and also have him pay the $2293, for a total of $3391. He only owes them $2293. The way that it should be is, he owes the state $595 and his ex's $1735 is wiped out by the order the judge sighned or the ex gets the $1698 not the state. Am I the only one who see's a problem here? We have called the csru  and been down to the local office and all we get is the runaround and no answers. We have tried to contact the csru's attorney, who drew up the new motion, but we cant get anywhere there!!! Do we have  to get screwed anymore than we already have.We cant make our bills, are about to lose our house, and we cant afford a lawyer. They take almost 2 weeks of his pay a month for support and back support and we are still paying on the bills the ex left and our lawyer and her lawyer!The system just keeps drowning us!!! If they were to wipe out her back child support, and we only had to pay them the $595, the extra money taken out of his paycheck would stop soon and we could make it. I feel totally helpless!!!!!! Does anyone know someone at the csru that could help or is for fathers???

They don't care if the ncps can pay their bills!! They don't care if they leave you with anything!!! they don't care about your child!!! all they care about is getting every red cent they can out of you!! They don't even care if any of it even gets to your ex so long as they can put the check mark in the box that they have taken everything they possibly can from you!! It's their job.

then they wonder why when someone snaps and looses it!! CRSU is one of the most screwed up gov orgs they have and thats saying a lot!! We need to find ways to fight them and undermine them at every chance.

 

We need to file lawsuits and complaints against them continuesly, we need to make it just way too costly to keep them around, only then will it get better.

We will gladly file a complaint. Do you know who or where to file it? We have already filed complaints against the lawyers and judge in the original case. The history here is way too long! If we had the money for a lawyer we would file a suit against the state, but they keep us broke, so we cant!

I feel for you.  Answer is...CSR does not care about the non-custodial parent.  In the case of women that pay child support - they find out real quick they are nobody as well.  You point out the state takes their cut and sometimes fails to credit you - yup!  You gotta watch these people because they will keep charging you and after you pay them (maybe twice) they feel it is up to you rectify the error.  They reason you can always get an attorney etc. 

 

Many members of this website are the "Second wife or girlfriend" that see the disparity and suffer alongside the guy.  If you get married...they will come after your joint account if he owes anything.  Good luck and economize if you want to stay together.  Tough times don't last but tough people do and I wish you both well.

I do not pay child support, but my husband does.  We have found out that if I deal with CSRU, things get settled much more quickly.  Have your boyfriend fax or send a signed paper stating that you are authorized information and to deal with his case.  Then if you don't get your questions/problems answered by the case worker, go straight to the supervisor.  There are 4 supervisors in the Main office in Des Moines.  Beverly was the one I dealt with.  She got things straightened out in less than a week for us.  We also received a letter apologizing for the mistake from our local office supervisor.  There is also a complaint process for the case worker if the problem lies with the case worker.  When I asked for information on this, things seemed to move even faster.  They really don't seem to care about fixing their mistakes unless you make it known that the issue is not going to go away.  Good Luck!

Good Point!  My mom had to check on something for me since I am out of the country and they were extremely courteous to her.  They gave her lots of advice on how I should pay without being overcharged and they authorized the release of my tax refund when they discovered they were holding it back for the sum of perhaps $20 overdue for my case a couple months previous.

 

Funny, they seem to respond better to women than men - I hadn't really put that one together but it all makes sense.  I think most men got to CSR with a pretty big chip on their shoulder.  A friend of mine once threatened to blow the place up and the man behind the counter said back to him, "is that a threat?"  My friend Rob G. responded "You're D___ Right it's a threat!"  Knowing Rob, I bet the guy probably realized Rob gets a little hot under the collar and just might be capable of something like that so he answered Rob's remaining questions without his previous hostility.  Considering Rob just proved with DNA the kid he had paid 12 years of child support was not his and CSR continued to collect child support despite a recent court order no wonder Rob was hot.  My point is that most men have some pretty good gripes when they go or call CSR and women have a little more control as they are usually an advocate rather than the person actually being burned.  So in the end it is not so much gender bias as a pragmatic response to so many ticked off men that CSR counselors talk to. 

 

That being said, I see being a worker at CSR as being party to a pretty nasty system.  I couldn't do it.

Thanks to all of you for the advice! It is true that they deal with women easier than men. I myself had to call and rectify a mistake they made for my ex, because they would not listen to him, but when I called and talked to them, they apologized and fixed the error. I didn't realize my boyfriend could authorize me to talk to them. They keep telling him that the information on his case is confidential and dont even want to give it to him. How can that be? It is his case just as much as it is his ex's!

Update. We took the advice given and we called and talked to a supervisor in Des Moines, her name was Beverly. My boyfriend gave her permission to talk to me and I explained the situation and she said she would look into it and call me back. She did call me back and stated that she thought she figured out the problem and was sending paperwork on it down to the Clinton office.

 

 In the mean time we went to the courthouse and filed paperwork to have the motion up for oral argument. The woman at the courthouse was very nice and did all the paperwork for us.

 

The next day we get a call from the attorney for the state. He refused to talk to me, so my boyfriend explained it to him. He told my boyfriend he would look into it. He didnt seem too happy when he found out a motion was filed in the court. He told my boyfriend there was no need to file a motion for an oral argument, my boyfriend stated to him that he was going to pursue every avenue available because he was tired of getting the shaft and he was not going to roll over anymore! 

 

So...we will see what happens!

Good job, you filed a motion wich means there be a record of their f--- up they don't like that. Keep filing the motions when they screw you and slowly we will nail the coffin shut on them.

Lawyers act in such a manner sometimes because they don't get the hardship they place on people and they don't like to admit mistakes.

We got a new motion from the lawyer for the state in the mail today. It is changed to say that the $2500 goes to satisfy what is owed to the ex and does not satisfy what is owed to the state. Fine, that is partially what we were after, but there is now no amounts in the motion as to how much he owes the ex or the state. I feel they are still trying to be sneaky by not putting the amounts down. I feel the motion should say $1735 is owed to the ex and $595 is owed to the state. Am I being to critical?

A crooked gov worker??!!! NO?!! Make them account for everything. $400,000 a year for an assistant in the unemployment office for example. They all are sneaky and crooked. Make them account and keep your hand on your wallet.

Just so you know; they don't always respond to women well.  I believe they're more curteous towards the new partner.  I'm the NCP, and a female and I've gotten nothing but crap.  I stopped paying my child support again as a protest against the system.  Also, because my daughter left her dad in 10/05.  I WAS paying child support, yet he wasn't required to pass any of that money to her.  My kids don't go without .  I'd just like to know where my money goes.  I know there's house payments, utilities, etc., HOWEVER, in my case, the ex DOESN'T HAVE A HOUSE PAYMENT!  The house he lives in was purchased by his new wife's parents, with the understanding that "they could pay what they can when they can."  However, when my support obligation was reviewed, he had the balls to claim he makes $700/month house payments.  Do the math.  Last year he and wife made under $18,000 and that was mostly from her income.  But that's another story.  Last year I got called into Support and Collections with a threat to suspend my driving license.  I got the VA to verify my disability.  Guess what?  They're making me go through the hoops again!  My doctor has to sign the statement again because the last time, for the question "Is the disability permanent?"  the doc indicated "unable to determine."  So, it's just a small gliche.

The bright spot?  I got a worker who used to be a very good co-worker of mine back in '99.  When she saw who I was, she said "so, is your ex still giving you grief?"  "That's why I'm here again."  She was good enough to find the hard copy of my medical statement immediately and send me the paperwork so the sanction won't happen.  I tend to have a very difficult time being civil towards these people, I know I often have a small chip on my shoulder.  I thank God that he placed a person who knows my history.  I pray He'll put a wise judge in the courtroom on May 22, when we finally get to present our case.

Another thing about tax refund intervention.  If you get a substantial refund, you're claiming incorrectly.  The ideal thng at tax time is to claim enough so that you either have to pay a couple hundred or get a couple hundred back.  If you're getting big chunks of money, it means Uncle Sam gets to use your money, without interest to you, for an entire year!  Why would anyone do that?  True, if it's the only way you believe you can get caught up on back support, then I suppose that's a matter of discipline.  Personally, if I was getting large amounts back, I'd talk with payroll and get that fixed so YOU can have control over how much you pay each month in back child support.  I'm also betting that even if they make a mistake and take more than they're supposed to, when they give you your money back, there's NO INTEREST???  Just a thought.  Don't let the government have your money for free.

Another thing.  If your ex receives cash assistance, child support works this way.  They "advance" the money to the ex, believing they'll recoup it through garnishment.  They can do this for five years, at which time the ex no lonver receives cash assistance (although they may still qualify for food stamps and medical help).  Therefore, they have the right to intercept your refund for owed support, if they've basically fronted the money to the ex.  However, if that's not the case, any money they intercept through tax refunds is SUPPOSED TO GO DIRECTLY TO THE EX.

I don't know how long the rest of you have been fighting the system, but I've been on the battlefield since 7/29/99.  I'm starting to get very battle-fatigued.  Pray for us all, please.

Speaking of tax refunds, how would a primary custodial parent know if NCP is claiming child on tax filing?  Would the IRS contact my brother?

 

In my brother's case, he is CP, and Mom hasn't been ordered to pay CS.

 

I found out when Mom & step-dad filed in 1997, they falsified their address. KS has a tax warrant out for them, for money they owe.

 

I found out by calling the county assessor, the address these people listed has been a parking lot for a school, since 1994. 

 

County assessors offices & web sites are a wonderful thing!

The point is that anybody on the wrong side of the system is naturally hostile to the workers so they routinely get defensive when the non-custodial parent is calling.  I don't think avoiding child support is a long-term solution since you lose all rights in this society and I cherish my rights.  The system is terribly unjust but I still work within the system as long as I have the means to do so which includes paying child support.  The major problem I have is when I hear about child support assignments that are beyond the ability of a person to pay given their current income.  What can a person do at that point but not pay?

Everyone knows how I feel about the CSRU...It's all about the State of Iowa collecting child support in any manner possible so they can receive the Federal Monies provided upon the collection.

I have an update. After countless hours on the phone and putting together paperwork, my boyfriend had his day in court.

 

The judge was very helpful(the same judge who denied my boyfriend joint physical care and awarded primary care to a bar fly) and told my boyfriend what motions to file if the record was not satisfied(in front of the CSRU lawyer).  The lawyer for the CSRU told the judge they had "muddied the waters on the calculations originally".

 

After hearing the judge and seeing all the documentation we had, the CSRU lawyer agreed with us and the amounts on the case will be $275 owing to the state and he will have a child support CREDIT of $700. Its too bad they wont return the $700, but at least it is now right!

 

 One tiny victory!!!

I still don't understand how the F--- someone can owe the state for child support. isn't the money supposed to be going for the kids not some beurocrats pocket! How about some state aid for fathers who can't pay their bills after child support is payed? 

Maby NCP should demonstrate and have a skip work and don't buy anything day.

The IRS doesn't know in advance who will claim a deduction. They honor the first person to declare the SSN for the deduction and when the second return shows up with the same SSN for a deduction they reject it.  My accountant told me the whole deal on this once so I am struggling to remember exactly but I believe audits and court orders follow.  If somebody wrongfully claims a deduction and a judge orders the deduction given to somebody else it can get real messy for the person claiming that deduction.

The IRS is a first come first serve entity though if that helps explain how they operate.  They don't make judgements they just honor the first one sent to them.

The money owed to the state is money the ex collected from FIP. Instead of getting a job, she went on welfare before there was a child support order. The state of Iowa makes the father pay them back for the money she collected. I know several fathers who are being made to pay back money the ex's collected from the state. It's not fair, if these women are able to work, they need to get a JOB, not collect welfare. When I was a single mother, I worked 3 jobs to make ends meet. Now my boyfriend and I both work to try to keep afloat, while the ex's lazy butt collects child support and state aid. Yet she has the money to be in the bars all the time! Go figure!

They can't get extra money though from you.  I think this system is pretty fair within this unfair system (if that makes sense) because if a person is not able to collect child support the state has to step in during the interim.  The court finally catches up with child support and makes u pay them for what they paid but not more than what child support could collect for that month.

Ken is right!  If a parent receiving child support starts receiving social services like welfare, the state collects the child support paid for that month instead of the child support going to the custodial parent.  In cases where a child support order was not established and a custodial parent starts receiving social services like welfare, the state can only make the non-custodial parent responsible for the amount equal to the child support obligation.
